REGULAR LICENSE AGREEMENT

This is a license agreement between you and Julien Bigot (owner of Metaheros.art) that explains how you can use illustrations, mockups and vectors that you license from Metaheros.art. By downloading content from Metaheros.art, you accept the terms of this agreement.

Licenses

Metaheros offers two license types: regular and premium. Every artwork that may be downloaded from Metaheros.art is covered by a regular license.

An extended license (called premium License) allows you extra rights of use in compensation for an additional license fee. Unless you buy an extra license, the regular licence terms rule your usage of material. You may license files from Metaheros.art by purchasing the artwork.

Metaheros.art provides images and vectors for purchase.

You may use watermarked material from Metaheros.art free of charge for testing or sample layout (composite) purposes only.

Content that has been watermarked cannot be used in any final or publicly accessible publications and may only be used for 30 days after download.

How do I use licensed material?

You may use material in any form that is not restricted by the author (please check Restricted Uses below). Subject to these restrictions and the other conditions of this agreement, Metaheros.art grants you the following permissions:

Perpetual

Your rights to use the downloaded graphic materials are permanent, i.e. there is no expiration or termination date. Unless the agreement is not respected.

Non-exclusive

meaning you have no exclusive rights to use the material. The same graphic material may be licensed to many consumers through metaheros.art.

Worldwide

implying that material may be utilized in any geographic region.

Limited to one project

This means you may use the graphic material in  only one project and medium.

Defining “Use”

This agreement defines “use” as the act of copying, reproducing, modifying, editing, synchronizing, performing, displaying, broadcasting, or publishing, or otherwise make use of.

Examples:

Websites, blog entries, social media, ads, marketing campaigns, corporate presentations, newspapers, magazines, books, film and television productions, online and mobile apps, and product packaging are examples of uses for licensed material.

Please read the section on Restricted Uses below for exceptions.

Restricted Uses

No False Claims of Authorship

With this sagreement, you may not misrepresent yourself as the original creator of an artwork that consists mainly licensed material. You cannot, for example, produce a picture based exclusively on licensed content and claim authorship.

No Standalone File Use

You may not use content in any way that allows others to download, extract, or redistribute content as a standalone file.

This implies you can use Metaheros’ products for your clients, but our licenses do not enable you to transmit our data or artworks in their entirety to another party. You maintain ownership of the material.

If your client wants anything to be created using the licensed material, they must commission new work from you.

No Commercial Use of “Editorial-Use-Only” Content

You may not use editorial-use-only artworks for commercial, promotional, advertorial, endorsement, advertising, gambling, gaming, betting, or merchandising purposes. This kind of content is intended for editorial purposes like news reporting and debate of current events or other things of human interest (for example, in a blog, textbook, brochure, newspaper or magazine article).

No Illegal Use

You guarantee to never use our Artworks in a pornographic, defamatory, or otherwise illegal way, to encourage violence or hatred, or in violation of all applicable rules and industry codes.

No Use in Trademark or Logo

Unless you purchase a custom license, you may not use content (in whole or in part) as the distinctive or distinguishing feature of a trademark, design mark, tradename, business name, service mark, or logo. Additionally, you shall not be entitled to register (in any jurisdiction) such content (in whole or in part) as a trademark or rely on any such registrations, prior use, and/or accrued goodwill to prevent any third party use of the content or any similar content (including by us, our customers, or the copyright owner of such content).

Products for resale/digital templates

Restricted Uses – unless extended license purchased. Extended licenses are only available for purchase with credits on a file by file basis.

Not suitable for Products for Resale. 

Unless you obtain a Premium license, you may not use the artwork in association with any products or services intended for resale or distribution where the main value is in the content itself.

This includes physical things such as cards, stationery, clothes, and posters, as well as digital products such as mobile applications and non-fungible tokens (NFT). This also applies to “on demand” products when a third party chooses the content for personalization on a made-to-order basis, such as products offered on websites such as Zazzle, Redbubble, Spreadshirt and CafePress.

No digital Templates. 

Unless you purchase a premium license, You may not use the artworks in digital templates intended for resale or other (for example, website templates, business card templates,  greeting card templates, brochure design templates). Extended licenses for Music for this purpose are not available (i.e. no electronic template use, including, without limitation, in a product or service that enables an end user to create soundtracks, in a system that resells products that include the Music, or in any “build-it-yourself” media tools).

Limited print run.

Unless you purchase an Premium License, you may not reproduce the content more than 5,000 times in physical print form. This restriction does not apply to electronic reproduction.

No Machine Learning, AI

Unless expressly authorized by metaheros.art you may not use content (including any caption information, keywords or other metadata associated with the content) for any machine learning and/or artificial intelligence purposes, or for any technologies designed for or intended for the identification of natural persons. Additionally, metaheros.art does not represent or warrant that consent has been obtained for such uses with respect to model-released content.

Who, besides me, can use the licensed content?

The rights granted to you are non-transferable and non-sublicensable, meaning that you cannot transfer or sublicense them to anyone else. There are two exceptions:

Employer or client. If you are purchasing on behalf of your employer or client, then your employer or client can use the content. In that case, you represent and warrant that you have full legal authority to bind your employer or client to the terms of this agreement. If you do not have that authority, then your employer or client may not use the content.Subcontractors. You may allow subcontractors (for example, your printer or mailing house) or distributors to use content in any production or distribution process related to your final project or end use. These subcontractors and distributors may not use the content for any other purpose.

Please note that seat/user restrictions apply. You may only use the content with the appropriate amount of users, as explained in Section 5 below.

Are there any seat/user license restrictions?

Yes. The standard license or subscription is for a single user. The seat/user restrictions refer to the raw file of content, not the end project or use.If you licensed the content with credits, this means that you may share content within your single legal entity but the content may only be available to one person at any one time. Unless you purchase an extended license, you may not store the content on a server (giving more than one person simultaneous access to the content).If you licensed the content with a subscription, this means that only one person (the same person) may access, license and use the content.If you need more than a single user to access the content:

Attribution.

Do I need to include a credit? 

You do not need to include a credit for commercial use, but if you are using content for editorial purposes, you must include the following credit adjacent to the content or in visual production credits: “metaheros.art”

Refunds Policy

Kindly be informed before purchasing an artwork, that we do not offer refunds on any items sold on metaheros.art.
